Before requesting access

The risks of litigation funding for an investor.

A case can be lost, a losing party may not pay, and a case often lasts two to four years, sometimes longer. The capital invested can be lost, in part or in full. The risks are set out below before any request for access, and the fund documentation details them once eligibility has been verified.

Hello Justice Capital 1 is offered as a private placement (article L. 411-2 of the French Monetary and Financial Code), from €100,000, once each investor’s eligibility has been verified.

The risks in detail.

The outcome of a case depends on the evidence, the law, the opposing party’s solvency and the length of the proceedings. Each of these factors carries a risk.

  • Capital loss.

The capital invested can be lost, in part or in full, and nothing guarantees it. The order of distributions set by the articles of association repays the capital first, but it does not create the sums to distribute: they come from cases won or settled.
  • A lost case.

A case can be lost, or settled for less than expected. The fund then recovers nothing on that case, and the client repays it nothing: the funder bears the risk of the proceedings.
  • An insolvent losing party.

A favourable judgment brings in nothing if the losing party cannot pay. Enforcement, conducted by a commissaire de justice, can take time and can fail. Solvency is checked before the commitment, and it can deteriorate during the proceedings.
  • Length of proceedings.

A case often lasts two to four years, sometimes longer. An appeal lengthens it, a settlement shortens it. The fund’s first years are spent taking on cases and running the proceedings, and distributions follow the outcomes.
  • Locked redemptions and no secondary market.

Redemptions are locked for ten years. Distributions are paid as cases conclude. There is no secondary market for the units, and a transfer must be approved under the articles of association. This investment does not suit you if you may need the money within ten years.
  • Concentration.

Each case remains individual, and losing one does not bring down the others. Diversification across many cases limits the risk without removing it: a series of similar cases shares the same law, and can be hit all at once. The fund’s first programme covers a single type of dispute, Swiss franc mortgages.
  • Dependence on the law firm and the court.

The client’s lawyer runs the case, and the court decides. Hello Justice is not a law firm and runs no proceedings: it selects the cases and follows them. The client remains free to choose their lawyer.
  • A single law firm.

ACTIVE AVOCATS, a firm of the COGEP group, conducts all the proceedings in the Swiss franc loan programme, and the programme depends on its continuity.
  • Key people.

The programme relies on the founding team of Hello Justice, and the way it is run depends on their continued involvement.
  • Law firm capacity.

The programme’s pace requires the partner law firms that conduct the proceedings to expand their capacity. If it does not keep up, cases are taken on more slowly.
  • Case law.

A reversal of case law can affect several cases at once, especially within a series of similar cases. The Swiss franc loan cases rest on the Cour de cassation rulings of 9 July 2025, recent case law, liable to change, which open unfair‑terms protection to borrowers paid in Swiss francs and, on the same day, uphold the clause of a bank that had informed its client clearly.
  • Track record.

Hello Justice Capital 1 was incorporated on 15 July 2025 and does not yet have a distribution history. The figures of listed funders are third‑party data, unrelated to the fund’s performance.

Hello Justice Capital 1

How the fund handles these risks.

Selection, the written review of each case, follow‑up and the members’ vote reduce the risk without removing it.

Case‑by‑case selection
A specialised partner lawyer analyses each case’s eligibility: the features of the dispute, the limitation period, the completeness of the documents, reasonable prospects of success. Hello Justice then reviews the amount at stake, the opposing party’s solvency, and the length and cost of the proceedings. Not every case is accepted.
A written review, with no score
In the Swiss franc loan programme, a specialised partner lawyer reviews each case on its documents before the agreement. For other disputes, Hello Justice delivers a written report and a funding opinion before signing. No case is scored: the opinion says what argues for it and what argues against it.
Follow‑up on the platform
Each funded case is followed through to its conclusion on the platform built and owned by Hello Justice, where the client, their lawyer and the investor each have their own space. The report to subscribers covers actual results only.
Collective governance
The members vote on every investment and every divestment concerning a major dispute (article 10.2 of the articles of association). The founders invest in the fund alongside the other members, and the manager only receives its share of distributions after their capital has been repaid.
One agreement per case
Each case has its own agreement, signed with the client and their lawyer before any commitment. It sets the fees the fund pays and the commission it takes out of the sums recovered, only in the event of success.
Many individual cases
The fund’s first programme covers a single type of dispute, Swiss franc mortgages, where each case keeps its own lawyer, agreement and documents. The capital is spread across many cases, but the same change in case law can affect them together: diversification limits the risk without removing it.

What the documentation details.

It is provided in your space once eligibility has been verified, in French and in English.

  • The risk factors.

The fund presentation and the articles of association describe the risks on this page and those of the structure: the transfer of units and the death of a member (article 8.2 of the articles), the fund’s tax regime.
  • The terms and the fees.

The documentation sets out the subscription amount, the entry fees, the management fees, the manager’s performance fee and the exit terms.
  • The 2026-2035 business plan.

The manager’s assumptions and what they produce over the life of the fund. These assumptions guarantee nothing.
  • The report to subscribers.

It reports actual results only, each dated: cases funded, outcomes, sums recovered and distributions.

Questions about the risks.

Yes. The capital invested can be lost, in part or in full, and nothing guarantees it. Distributions depend on the cases won or settled, and on the sums actually recovered.
