Understanding the asset class

Litigation funding as an asset uncorrelated with the markets.

The outcome of a case depends on the evidence, the law, the opposing party’s solvency and the length of the proceedings. It does not depend on the financial markets. That independence sets litigation funding apart as an asset class. It does not remove the risk: a case can be lost.

Hello Justice Capital 1 is offered as a private placement (article L. 411-2 of the French Monetary and Financial Code), from €100,000, once each investor’s eligibility has been verified. The capital invested can be lost, in part or in full.

Where a case outcome comes from.

A case is won or lost on its documents, on the applicable law, on the losing party’s ability to pay and on the time the proceedings take. None of these four factors follows a stock index.

  • The evidence and the law.

The documents in the case and the applicable law decide the outcome. A fall in equity markets changes nothing in a case, and a rise adds nothing to it.
  • The opposing party’s solvency.

A favourable judgment brings in nothing if the losing party cannot pay. The funder checks that solvency before committing, and it favours disputes against banks, insurers and sound companies. An economic crisis can weaken a debtor, so the lack of correlation is not complete.
  • The length of the proceedings.

A case often lasts two to four years, sometimes longer. Its timetable depends on the courts, on a settlement that shortens it or on an appeal that lengthens it.
  • Diversification.

Each case remains individual, with its own lawyer and its own agreement: losing one does not bring down the others. A reversal of case law can however affect several cases of the same series at once.
  • The risk remains.

An uncorrelated asset remains a risky asset. A case can be lost, a settlement can fall short of what was expected, and the capital invested can be lost, in part or in full.

What it requires of an investor.

An investor commits money that will not be needed for ten years, and accepts a possible loss.

  • The horizon.

Redemptions are locked for ten years. Distributions are paid as cases conclude, as and when they are won or settled.
  • Liquidity.

There is no secondary market for the units, and a transfer must be approved under the articles of association. This investment does not suit you if you may need the money within ten years.
  • Diversification.

The fund finances many cases, each assessed on its own merits, and each case stands alone. How much of your wealth to place in it is a decision for you and your advisers.
  • The risk of loss.

The capital invested can be lost, in part or in full, and nothing guarantees it. Hello Justice Capital 1 was incorporated on 15 July 2025 and does not yet have a distribution history.

More than 500 live cases
Hello Justice SAS, the manager, has more than 500 live cases, taken on since 2024, including the Swiss franc loans programme, where each case remains individual.
A private placement
Hello Justice Capital 1 is offered as a private placement (article L. 411-2 of the French Monetary and Financial Code), from €100,000, once each investor’s eligibility has been verified. The full documentation, terms and fees included, opens in your space.
Collective governance
The members vote on each major dispute (article 10.2 of the articles of association). Distributions first repay the capital, before any share goes to the manager.

Frequently asked questions.

It is an asset whose outcome does not depend on equity or bond markets. Litigation funding is one: the outcome of a case depends on the evidence, the law, the opposing party’s solvency and the length of the proceedings. That guarantees nothing: a case can be lost.
